Debt counselling enables debt ridden consumers to seek budgetary advice with the aim of negotiating lower monthly repayment obligations with their creditors so as to restructure their debt into more affordable monthly payments.
By law, over indebted consumers who sign up for a formal debt counselling process are protected from prosecution for non payment of the full amounts owing during the negotiation period.
It is important to note that the debt counselling process does not indemnify consumers from making regular monthly payments to their creditors.
Debt counselling can only be carried out by a counsellor who is registered with the National Credit Regulator (NCR) and whose task it is to assist indebted consumers who are struggling to meet their debt related obligations.
Debt counsellors are typically independent or part of an organisation, but by law, they cannot extend credit or be associated with debt collection agencies or credit bureaus. Indebted consumers can either approach debt counsellors directly or they may be referred to one by the court or one’s creditors. Debt Counselling Costs in Witbank:
Debt counsellors are entitled to an application fee limited to the amount prescribed in terms of Schedule 2 (2) of the Act which is paid directly by the applicant. Rejection fees limited to the amount prescribed by the act is R 300.00 excluding VAT and applies to consumers who’s applications have been rejected in terms of section 86(7)(a).
A debt restructuring fee of the lower of the first instalment of the restructured plan or a maximum of R 6000.00 excluding VAT is due to the debt counsellor by consumers whose applications have been approved. This fee is payable at the first instalment. Where a debt counsellor fails to submit debt repayment proposals to credit providers or fails to refer the matter to a Tribunal or a Magistrate’s Court within the prescribed 60 days of the date of debt review, the consumer is entitled to a 100% refund of the re-structuring fee less the application fee.
